Key Steps in the Probate Process

Will Verification

The first step is to check whether there is a valid Will and whether it is the latest version. If a Will exists, the named executors will usually be responsible for administering the estate.

The deceased person’s assets and debts must be identified and valued. This may include bank accounts, property, investments, personal possessions, business interests, jointly owned assets and overseas assets.

 

Probate Application

The appropriate application must be prepared for a Grant of Probate or Letters of Administration. Where inheritance tax is due, or where full estate details are required, HMRC forms and inheritance tax reporting may also be needed.

 

Post-Grant Administration

Once the Grant has been issued, executors or administrators can collect assets, sell property where required, pay debts, settle tax matters and continue with the administration of the estate.

 

Beneficiary Communication and Distribution

Estate accounts should be prepared and beneficiaries should be kept informed. Once liabilities and tax matters have been dealt with, the estate can be distributed according to the Will or intestacy rules.

Taxable or Complex Estate £2,400 – £6,000 plus VAT
Estate Administration Fees 0.75% – 2.5% of the gross estate value, subject to a minimum fee of £1,500, plus an hourly rate of £120 – £350 plus VAT where applicable.
Common Disbursements
Probate Application Fee £300 if the estate is over £5,000. No probate application fee is payable if the estate is £5,000 or less.
Additional Copies of the Grant £16 per additional copy.
Bankruptcy Land Charges Department Searches Usually £2 per beneficiary.
Notices in The London Gazette Usually from £80, subject to publication charges.
Local Newspaper Notices Usually £120 – £200, depending on the publication.
